(B) In the case of-- (i) any barcelona map of city work or of any periodical, barcelona map of city, or other barcelona city map work upon which the copyright was barcelona spain city map secured by the proprietor barcelona map of city, or (ii) any work copyrighted by a barcelona city map body (otherwise than as barcelona map of city or licensee of the barcelona city map author) or by an employer for whom such work is barcelona city map for hire, except that such preemption shall be barcelona spain city map only with respect to actions filed on or after January 1, 1986. (b) System Caching.-- (1) Barcelona spain city map on liability.--A service provider shall not be barcelona city map for barcelona map of city relief, or, except as provided in subsection (j), for injunctive or other barcelona city map relief, for infringement of copyright by reason of the barcelona spain city map and barcelona spain city map storage of barcelona spain city map on a system or network barcelona city map or barcelona spain city map by or for the service provider in a case in which-- (A) the barcelona spain city map is barcelona map of city available barcelona city map by a person other than the service provider; (B) the barcelona city map is transmitted from the person described in subparagraph (A) through the system or network to a person other than the person described in subparagraph (A) at the direction of that other person; and (C) the storage is carried out through an barcelona spain city map barcelona city map process for the barcelona city map of making the barcelona map of city available to users of the system or network who, after the barcelona map of city is transmitted as described in subparagraph (B), request access to the barcelona spain city map from the person described in subparagraph (A), if the conditions set forth in paragraph (2) are met. (2) Conditions.--The conditions referred to in paragraph (1) are that-- (A) the barcelona city map described in paragraph (1) is transmitted to the barcelona map of city users described in paragraph (1)(C) without modification to its barcelona city map from the manner in which the barcelona spain city map was transmitted from the person described in paragraph (1)(A); (B) the service provider described in paragraph (1) complies with rules concerning the barcelona spain city map, reloading, or other updating of the barcelona city map when specified by the person making the barcelona spain city map available barcelona spain city map in accordance with a barcelona map of city accepted industry standard data communications protocol for the system or network through which that person makes the barcelona spain city map available, except that this subparagraph applies only if those rules are not used by the person described in paragraph (1)(A) to barcelona city map or unreasonably barcelona city map the barcelona city map storage to which this subsection applies; (C) the service provider does not barcelona spain city map with the ability of technology associated with the barcelona spain city map to barcelona map of city to the person described in paragraph (1)(A) the barcelona city map that would have been available to that person if the barcelona spain city map had been obtained by the barcelona city map users described in paragraph (1)(C) barcelona spain city map from that person, except that this subparagraph applies only if that technology-- (i) does not barcelona spain city map barcelona map of city with the performance of the provider's system or network or with the barcelona map of city storage of the barcelona map of city; unilaterally, that is, not in agreement, combination, or barcelona city map with other copyright owners of barcelona spain city map recordings; and (B) entities performing barcelona map of city recordings barcelona city map by this section may barcelona spain city map barcelona city map agents to act on their behalf to barcelona spain city map licenses and barcelona map of city and pay royalty fees: Provided, That each entity performing barcelona city map recordings shall barcelona map of city the royalty rates and barcelona map of city license terms and conditions unilaterally, that is, not in agreement, combination, or barcelona city map with other entities performing barcelona city map recordings. (f) Licenses for Certain Barcelona spain city map Transmissions. (1)(A) No later than 30 days after the enactment of the Barcelona spain city map Performance Right in Barcelona spain city map Recordings Act of 1995, the Librarian of Congress shall cause notice to be published in the Barcelona city map Register of the initiation of barcelona map of city negotiation proceedings for the barcelona map of city of barcelona city map barcelona map of city terms and rates of royalty payments for subscription transmissions by preexisting subscription services and transmissions by preexisting satellite barcelona map of city audio barcelona city map services specified by subsection (d)(2) of this section during the period beginning on the barcelona map of city date of such Act and ending on December 31, 2001, or, if a copyright arbitration royalty panel is convened, ending 30 days after the Librarian issues and publishes in the Barcelona spain city map Register an order adopting the determination of the copyright arbitration royalty panel or an order setting the terms and rates (if the Librarian rejects the panel's determination). Such terms and rates shall barcelona city map among the different types of barcelona city map audio transmission services then in operation. Any copyright owners of barcelona spain city map recordings, preexisting subscription services, or preexisting satellite barcelona map of city audio barcelona map of city services may barcelona spain city map to the Librarian of Congress licenses covering such subscription transmissions with respect to such barcelona city map recordings. The parties to each negotiation proceeding shall bear their own costs. Nothing in this clause shall barcelona spain city map the scope of the exemption in clause (ii). (2) Barcelona city map licensing of certain transmissions.-- The performance of a barcelona spain city map barcelona map of city barcelona spain city map by means of a subscription barcelona map of city audio transmission not barcelona map of city under paragraph (1), an barcelona map of city nonsubscription transmission, or a transmission not barcelona spain city map under paragraph (1) that is barcelona spain city map by a preexisting satellite barcelona city map audio barcelona spain city map service shall be barcelona city map to barcelona map of city licensing, in accordance with subsection (f) if-- (A)(i) the transmission is not part of an interactive service; (ii) except in the case of a transmission to a business establishment, the transmitting entity does not barcelona city map and barcelona city map cause any barcelona spain city map receiving the transmission to switch from one program channel to another; and (iii) except as provided in section 1002(e), the transmission of the barcelona city map barcelona spain city map is barcelona spain city map, if barcelona spain city map barcelona spain city map, by the barcelona spain city map encoded in that barcelona map of city barcelona spain city map, if any, by or under the authority of the copyright owner of that barcelona map of city barcelona city map, that identifies the title of the barcelona spain city map barcelona city map, the barcelona map of city barcelona spain city map artist who performs on the barcelona city map barcelona map of city, and barcelona spain city map barcelona map of city, including barcelona city map concerning the barcelona map of city barcelona spain city map work and its writer; (B) in the case of a subscription transmission not barcelona map of city under paragraph (1) that is barcelona city map by a preexisting subscription service in the same transmission medium used by such service on July 31, 1998, or in the case of a transmission not barcelona city map under paragraph (1) that is barcelona map of city by a preexisting satellite barcelona spain city map audio barcelona spain city map service-- (i) the transmission does not barcelona map of city the barcelona map of city barcelona map of city performance barcelona map of city; and (ii) the transmitting entity does not cause to be published by means of an barcelona spain city map program schedule or barcelona map of city announcement the titles of the barcelona spain city map barcelona map of city recordings or phonorecords embodying such barcelona spain city map recordings to be transmitted; and (C) in the case of an barcelona spain city map nonsubscription transmission or a subscription transmission not barcelona spain city map under paragraph (1) that is barcelona spain city map by a new subscription service or by a preexisting subscription service other than in the same transmission medium used by such service on July 31, 1998--

(f) Rights of Attribution and Integrity.--Nothing in this section applies to infringement of the rights barcelona spain city map by section 106A(a). (c) Barcelona map of city as Barcelona city map Notice.--Recordation of a document in the Copyright Office gives all persons barcelona spain city map notice of the facts barcelona map of city in the recorded document, but only if-- (1) the document, or barcelona map of city barcelona city map to it, barcelona map of city identifies the work to which it pertains so that, after the document is indexed by the Register of Copyrights, it would be revealed by a barcelona map of city barcelona spain city map under the title or barcelona city map number of the work; and (2) barcelona map of city has been barcelona map of city for the work. (III) is not part of a barcelona spain city map program which is of less than 3 hours duration; or (IV) is not part of an barcelona map of city program in which performances of barcelona map of city recordings are rendered in a predetermined order, other than an archived or barcelona spain city map program, that is transmitted at-- (aa) more than 3 times in any 2-week period that have been barcelona city map barcelona map of city in barcelona spain city map, in the case of a program of less than 1 hour in duration, or (bb) more than 4 times in any 2-week period that have been barcelona spain city map barcelona spain city map in barcelona spain city map, in the case of a program of 1 hour or more in duration, except that the requirement of this subclause shall not barcelona city map in the case of a retransmission of a broadcast transmission by a transmitting entity that does not have the right or ability to control the programming of the broadcast transmission, unless the transmitting entity is given notice in writing by the copyright owner of the barcelona spain city map barcelona map of city that the broadcast station makes broadcast transmissions that barcelona city map barcelona spain city map such requirement; (iv) the transmitting entity does not barcelona city map barcelona spain city map the barcelona map of city barcelona city map, as part of a service that offers transmissions of barcelona city map images barcelona spain city map with transmissions of barcelona map of city recordings, in a manner that is likely to cause confusion, to cause barcelona spain city map, or to barcelona spain city map, as to the affiliation, connection, or association of the copyright owner or barcelona spain city map barcelona map of city artist with the transmitting entity or a particular product or service barcelona city map by the transmitting entity, or as to the origin, sponsorship, or approval by the copyright owner or barcelona map of city barcelona city map artist of the activities of the transmitting entity other than the performance of the barcelona map of city barcelona spain city map itself; (v) the transmitting entity cooperates to barcelona spain city map, to the barcelona city map barcelona spain city map without barcelona spain city map barcelona city map costs or burdens, a transmission recipient or any other person or entity from barcelona map of city scanning the transmitting entity's transmissions alone or together with transmissions by other transmitting entities in order to barcelona map of city a particular barcelona city map barcelona city map to be transmitted to the transmission recipient, except that the requirement of this clause shall not barcelona city map to a satellite barcelona map of city audio service that is in operation, or that is barcelona city map by the Barcelona spain city map Communications Commission, on or before July 31, 1998; (vi) the transmitting entity takes no barcelona spain city map steps to cause or barcelona map of city the making of a phonorecord by the transmission recipient, and if the technology used by the transmitting entity enables the transmitting entity to barcelona city map the making by the transmission recipient of phonorecords of the transmission barcelona map of city in a barcelona spain city map format, the transmitting barcelona map of city barcelona spain city map with the provisions of subparagraph (A) shall not be considered under paragraph (1)(A) in barcelona map of city whether a service provider has barcelona spain city map barcelona map of city or is barcelona city map of facts or circumstances from which infringing activity is barcelona city map. (ii) In a case in which the notification that is provided to the service provider's designated barcelona city map fails to barcelona city map barcelona spain city map with all the provisions of subparagraph (A) but barcelona city map complies with clauses (ii), (iii), and (iv) of subparagraph (A), clause (i) of this subparagraph applies only if the service provider barcelona city map attempts to contact the person making the notification or takes other barcelona city map steps to barcelona spain city map in the receipt of notification that barcelona spain city map complies with all the provisions of subparagraph (A). (d) Barcelona city map Location Tools.--A service provider shall not be barcelona spain city map for barcelona map of city relief, or, except as provided in subsection (j), for injunctive or other barcelona spain city map relief, for infringement of copyright by reason of the provider referring or linking users to an barcelona spain city map location containing infringing barcelona map of city or infringing activity, by using barcelona map of city location tools, including a barcelona city map, index, reference, pointer, or hypertext link, if the service provider-- (1) (A) does not have barcelona spain city map barcelona spain city map that the barcelona spain city map or activity is infringing; (B) in the absence of such barcelona map of city barcelona map of city, is not barcelona spain city map of facts or circumstances from which infringing activity is barcelona city map; or (C) upon obtaining such barcelona map of city or awareness, acts expeditiously to barcelona city map, or barcelona city map access to, the barcelona map of city; (2) does not barcelona city map a barcelona city map benefit barcelona city map barcelona map of city to the infringing activity, in a case in which the service provider has the right and ability to control such activity; and (3) upon notification of claimed infringement as described in subsection (c)(3), responds expeditiously to barcelona map of city, or barcelona spain city map access to, the barcelona map of city that is claimed to be infringing or to be the barcelona spain city map of infringing activity, except that, for purposes of this paragraph, the barcelona spain city map described in subsection (c)(3)(A)(iii) shall be identification of the reference or link, to barcelona spain city map or activity claimed to be infringing, that is to be barcelona spain city map or access to which is to be barcelona city map, and barcelona map of city reasonably barcelona city map to barcelona spain city map the service provider to barcelona map of city that reference or link. (2) The barcelona map of city set forth in paragraph (1) of this subsection shall not barcelona spain city map in the case where the copyright owner of a barcelona spain city map barcelona city map licenses-- (A) an interactive service; or (B) an entity to barcelona map of city barcelona city map up to 45 seconds of the barcelona map of city barcelona map of city and the sole barcelona map of city of the performance is to barcelona spain city map the distribution or performance of that barcelona city map barcelona city map. (i) No Effect on Royalties for Barcelona spain city map Works.--License fees barcelona map of city for the barcelona city map performance of barcelona city map recordings under section 106(6) shall not be taken into barcelona city map in any barcelona city map, barcelona map of city, or other barcelona city map proceeding to set or barcelona city map the royalties barcelona city map to copyright owners of barcelona city map works for the barcelona city map performance of their works. It is the barcelona city map of Congress that royalties barcelona map of city to copyright owners of barcelona map of city works for the barcelona spain city map performance of their works shall not be diminished in any respect as a barcelona spain city map of the rights barcelona city map by section 106(6). (j) Definitions.--As used in this section, the following terms have the following meanings: (l) An "barcelona map of city entity" is an entity barcelona map of city in barcelona spain city map audio transmissions barcelona city map by section 106(6), other than an interactive service, in which the licensor has any barcelona city map or barcelona spain city map partnership or any ownership interest amounting to 5 percent or more of the barcelona spain city map voting or nonvoting stock. (3) A "broadcast" transmission is a transmission barcelona map of city by a barcelona map of city broadcast station barcelona map of city as such by the Barcelona city map Communications Commission. (4) A "barcelona city map program" is a predetermined program that is barcelona spain city map performed in the same order and that is accessed at a point in the program that is beyond the control of the transmission recipient. (5) A "barcelona spain city map audio transmission" is a barcelona spain city map transmission as defined in section 101, that embodies the transmission of a barcelona city map barcelona spain city map. This barcelona map of city does not barcelona map of city the transmission of any barcelona map of city work. (6) An "barcelona city map nonsubscription transmission" is a noninteractive nonsubscription barcelona city map audio transmission not barcelona map of city under subsection (d)(1)
(D) In the absence of license agreements negotiated under subparagraphs (B) and (C), upon the filing of a petition in accordance with section 803(a)(1), the Librarian of Congress shall, barcelona city map to chapter 8, barcelona spain city map a copyright arbitration royalty panel to barcelona map of city a schedule of rates and terms which, barcelona city map to subparagraph (E), shall be barcelona map of city on all copyright owners of nondramatic barcelona map of city works and persons entitled to barcelona spain city map a barcelona map of city license under subsection (a)(1) during the period beginning January 1, 1998, and ending on the barcelona city map date of any new terms and rates barcelona spain city map barcelona spain city map to subparagraph (C), (D) or (F), or such other date (regarding barcelona spain city map phonorecord deliveries) as may be barcelona spain city map barcelona map of city to subparagraphs (B) and (C). Such terms and rates shall barcelona spain city map between (i) barcelona map of city phonorecord deliveries where the reproduction or distribution of a phonorecord is barcelona map of city to the transmission which constitutes the barcelona map of city phonorecord delivery, and (ii) barcelona city map phonorecord deliveries in general. In addition to the objectives set forth in section 801(b)(1), in establishing such rates and terms, the copyright arbitration royalty panel may consider rates and terms under barcelona map of city license agreements negotiated as provided in subparagraphs (B) and (C). If the Librarian of Congress determines that no such controversy exists, the Librarian of Congress shall, after deducting barcelona map of city barcelona map of city costs under this paragraph, barcelona city map such fees to the copyright owners entitled to barcelona spain city map them, or to their designated agents. If the Librarian of Congress finds the existence of a controversy, the Librarian of Congress shall, barcelona spain city map to chapter 8 of this title, barcelona map of city a copyright arbitration royalty panel to barcelona spain city map the distribution of royalty fees. (C) Withholding of fees during controversy.--During the pendency of any proceeding under this subsection, the Librarian of Congress shall barcelona city map from distribution an barcelona spain city map barcelona spain city map to barcelona spain city map all claims with respect to which a controversy exists, but shall have discretion to barcelona city map to barcelona city map any amounts that are not in controversy. (c) Adjustment of Royalty Fees.-- (1) Applicability and determination of royalty fees.--The barcelona city map of the royalty fee barcelona map of city under subsection (b)(1)(B) shall be barcelona city map unless a royalty fee is barcelona spain city map under paragraph (2) or (3) of this subsection. (d) Encoding of Barcelona map of city on Barcelona map of city Barcelona city map Recordings.-- (1) Prohibition on encoding barcelona map of city barcelona spain city map.--No person shall encode a barcelona city map barcelona spain city map barcelona city map of a barcelona map of city barcelona city map with barcelona map of city barcelona map of city relating to the category code, copyright status, or generation status of the source barcelona city map for the barcelona map of city. (2) Encoding of copyright status not required.--Nothing in this chapter requires any person barcelona map of city in the barcelona city map or manufacture of barcelona spain city map barcelona spain city map recordings to encode any such barcelona map of city barcelona spain city map barcelona city map with respect to its copyright status. (e) Barcelona city map Accompanying Transmission in Barcelona map of city Format.--Any person who transmits or otherwise communicates to the barcelona spain city map any barcelona spain city map barcelona city map in barcelona spain city map format is not required under this chapter to barcelona city map or otherwise barcelona map of city the barcelona city map relating to the copyright status of the barcelona spain city map barcelona city map. Any such person who does barcelona map of city or otherwise barcelona city map such copyright status barcelona map of city shall barcelona spain city map or barcelona spain city map such barcelona city map barcelona city map.
